Core Ethical Principles

Originality

Submitted manuscripts must present original legal scholarship and acknowledge all external sources accurately.

Legal Accuracy

Statutes, judgments, facts, legal principles, quotations and references must be represented honestly.

Research Ethics

Applicable consent, confidentiality, institutional permission and participant-protection requirements must be satisfied.

Transparency

Authorship, funding, conflicts of interest, methodology and relevant limitations should be disclosed clearly.

Responsibilities of Authors

  • Submit original work that is not under consideration by another journal.
  • Acknowledge all legal authorities, quotations, ideas, data and third-party material.
  • Do not fabricate, falsify, manipulate or selectively conceal evidence.
  • List only genuine scholarly contributors as authors.
  • Obtain consent, institutional approval or permission where required.
  • Protect confidential client, participant, organizational and case information.
  • Disclose funding and actual or potential conflicts of interest.
  • Inform the journal promptly when a significant error is discovered.

Originality and Plagiarism

Authors must provide proper acknowledgement whenever they use another person’s words, arguments, interpretations, research findings, legal analysis, tables, figures or other intellectual material.

Direct copying, close paraphrasing, translation without attribution, inappropriate reuse of earlier work or submission of another person’s work as original may be treated as plagiarism.

Submitted manuscripts may be examined for textual similarity, duplication and improper source use during editorial processing.

Unacceptable Publication Practices

Misconduct Description
Plagiarism Using another person’s words, ideas, legal analysis, data or material without proper acknowledgement.
Data Fabrication Inventing interviews, surveys, case records, evidence, participants or research findings.
Data Falsification Changing, omitting or manipulating evidence, documents or results in a misleading manner.
Duplicate Publication Publishing substantially the same manuscript more than once without transparent disclosure.
Simultaneous Submission Submitting the same manuscript to more than one journal at the same time.
Authorship Misconduct Including non-contributors or excluding individuals who made substantial scholarly contributions.
Citation Manipulation Adding irrelevant citations to influence citation counts or satisfy improper requests.
Peer-Review Manipulation Providing false reviewer identities or attempting to influence independent review improperly.

Duplicate and Simultaneous Submission

A manuscript submitted to JALS must not be under consideration by another journal at the same time.

Authors should disclose any related conference paper, thesis chapter, working paper, report, preprint or earlier publication where substantial overlap may exist.

Submitting substantially identical work to multiple publications without transparent disclosure may result in rejection or corrective action.

Authorship and Contributorship

Genuine Contribution

Authorship should be limited to individuals who made a substantial scholarly contribution.

Author Approval

All authors should approve the submitted manuscript and agree to the authorship order.

No Guest Authorship

Academic position, reputation or institutional authority alone does not justify authorship.

Contributor Recognition

Limited technical, editorial or administrative assistance may be acknowledged separately.

Corresponding Author Responsibilities

  • Confirm that all authors approved the manuscript.
  • Provide accurate names, affiliations and contact details.
  • Communicate editorial decisions to all co-authors.
  • Coordinate revisions and responses to reviewer comments.
  • Submit required declarations, permissions and supporting documents.
  • Inform the journal about authorship disputes or requested changes.
  • Review and approve the final publication proof.

Legal Accuracy and Source Integrity

  • Statutes and legal provisions should be cited accurately.
  • Judicial decisions should not be quoted selectively or misleadingly.
  • Jurisdictional differences should be identified clearly.
  • Repealed, amended or overruled authorities should be presented with proper context.
  • Primary legal sources should be used where reasonably available.
  • References should not be fabricated, incomplete or deliberately misleading.

Human-Participant and Socio-Legal Research

Legal research involving interviews, surveys, observations, personal records or identifiable individuals should respect dignity, privacy, voluntary participation and applicable ethical requirements.

  • Institutional or ethical approval should be reported where required.
  • Informed consent should be obtained where applicable.
  • Personal information should be anonymized or protected appropriately.
  • Additional safeguards should be applied to vulnerable participants.
  • Participants should not be exposed to unnecessary harm, pressure or deception.

Confidential Legal Information

Authors should not disclose confidential client communications, privileged documents, sealed court records, protected witness details, personal identifiers or commercially sensitive information without appropriate authorization.

Where confidentiality is required, names, case references, organizational details or other identifying information should be anonymized carefully.

Copyright and Permissions

  • Authors must obtain permission for protected third-party material where required.
  • Judicial extracts, photographs, tables, charts and archival documents must be acknowledged.
  • Citation alone may not replace formal permission for substantial reproduction.
  • Authors remain responsible for copyright and permission compliance.
  • Submitted material must not violate another person’s intellectual-property rights.

Funding and Conflicts of Interest

Authors should disclose financial, institutional, professional, personal or academic interests that may influence the research, interpretation or presentation of the manuscript.

Funding sources, sponsorship and the role of any supporting organization should be identified where applicable.

Use of Generative Artificial Intelligence

  • Artificial intelligence systems cannot be listed as authors.
  • Human authors remain responsible for all submitted content.
  • AI must not be used to fabricate cases, statutes, quotations, sources or research data.
  • All AI-assisted factual statements and references must be verified.
  • Confidential manuscripts and legal information must not be uploaded to unauthorized AI platforms.
  • Substantial AI assistance should be disclosed where required by journal policy.

Responsibilities of Reviewers

Responsibilities of Editors

  • Evaluate manuscripts fairly and without improper discrimination.
  • Protect author, reviewer and manuscript confidentiality.
  • Base decisions on originality, legal accuracy, relevance and ethical compliance.
  • Declare conflicts of interest and transfer manuscripts where necessary.
  • Examine credible complaints and allegations responsibly.
  • Take appropriate corrective action where reliable evidence exists.
  • Maintain editorial independence from improper commercial or institutional influence.

Editorial Independence

Editorial decisions should be based on the manuscript’s legal relevance, academic quality, originality, ethical preparation and contribution to scholarship.

Author status, institutional influence, personal relationships, payment or commercial considerations must not guarantee acceptance or favourable treatment.

Peer-Review Confidentiality

Submitted manuscripts, reviewer reports and editorial correspondence are confidential materials.

Editors and reviewers must not disclose, reproduce, distribute or use unpublished content without authorization.

Confidential manuscripts should not be uploaded to unauthorized external platforms or artificial intelligence systems.

Handling Allegations of Misconduct

Credible concerns may be examined confidentially, fairly and without unnecessary delay. The journal may request explanations, original data, source documents, consent records, permissions or other relevant evidence.

Authors, reviewers and editors are expected to cooperate with legitimate publication-integrity enquiries.

Procedure for Examining Concerns

Stage General Action
Initial Assessment The journal examines whether the allegation is specific, credible and relevant.
Evidence Review Relevant manuscripts, reports, sources, records or supporting documents may be examined.
Author Response The authors may be invited to provide an explanation or supporting evidence.
Independent Assessment Additional editorial or specialist advice may be obtained where appropriate.
Decision The journal determines whether corrective or disciplinary action is necessary.
Record Update Corrections, notices or other updates may be published to protect the scholarly record.

Possible Editorial Actions

Action Purpose
Manuscript Rejection Declines a submission affected by serious quality, originality or ethical concerns.
Review Suspension Temporarily pauses editorial processing while a concern is examined.
Correction Amends an error that does not invalidate the principal scholarly contribution.
Expression of Concern Alerts readers to a serious unresolved matter under investigation.
Withdrawal Records removal of a manuscript or publication under appropriate circumstances.
Retraction Identifies an article whose findings or ethical basis are no longer reliable.
Institutional Communication Refers a serious concern to the relevant institution or authority where appropriate.

Corrections and Retractions

Significant errors, unreliable findings or confirmed misconduct may require a formal correction, withdrawal, expression of concern or retraction notice.

Such notices should remain connected with the affected article to preserve transparency and protect the accuracy of the legal scholarly record.

Honest Errors

An honest error is not automatically treated as research misconduct. Authors should report significant mistakes promptly and cooperate with appropriate correction of the publication record.

The journal will consider the nature, extent and effect of the error when determining the appropriate editorial response.

Complaints and Appeals

Authors, reviewers and readers may submit complaints or appeals through the journal’s official communication channel.

The request should identify the relevant manuscript or article and provide specific evidence, legal reasoning or procedural grounds.

General disagreement with an editorial decision does not automatically establish malpractice or justify reversal of the decision.
